Drain cleaned out

The VanBuuren Drain has been cleaned out. Pictures to follow.

Thanks to the Drainage superintendant for making this happen.

I still wonder about the 2 undersized culverts. Not seeing them replaced with 1 big one.

Not seeing the shared farmers ditch cleaned out.
(the one that will keep on flooding and holding stagnant water, the one that the township has hooked up a municipal drain into). Hope it doesn't rain too much.

At least the drain has been cleaned out, good news.

All in all, alot of progress has been made these past 2 years.

It took 13 years to get the front roadside ditches working, and 15 years for the drain to get a clean out.

Van Buuren Municipal Drain Project 2015

The project is scheduled to begin October 26, 2015 and last for 20 working days.

All landowners that own lands within the watershed boundary of this Municipal Drain can expect a bill for the maintenance.

Total to all lands is $63,085.00

With that price tag lets hope that the maintenance can be done this year as promised, and that the 2 undersized culverts finally get replaced.

The following is my log of events regarding your involvement with the flooding problem to date.

On May 13, 2014 when the last flooding waters filled my boots I called and spoke to you on the phone. You said that you “will send someone out”.

Left on our answering machine was a message from xxx - Manager of road operations.

He said: “We know there’s a problem with the VanBuuren Drain”, and he has “fired off the report to the drainage superintendent to review”.

August 31, 2014 you were copied an email to xxx from the Niagara Region. In the email it stated: “Please respond to my emails regarding the repair and maintenance you are responsible for”.

September 1, 2014 you responded to my email saying that you cannot determine what the issue is and “a website fabricated from speculation hardly proves to be sound engineering analysis”.

September 2, 2014 I called and faxed you a letter spelling out the flooding issues and providing a link to the Grimsby Floods West Lincoln Blog at: http://grimsbyfloodswestlincoln.blogspot.ca/

September 5, 2014 you sent me an email: “kindly have my name removed or I will sue for damages for Public Defamation.”

September 5, 2014 I sent you an email indicating that I removed your name “as requested by your threat of lawsuit.”, and explained that my comments are “fair comments”, “not malicious”, and “based on fact”.

September 5, 2014 I sent you and email with the above phone message from xxx as an email attachment stating: “We know there’s a problem with the VanBuuren Drain” ,and he has “fired off the report to the drainage superintendent to review”.

September 5, 2014 you sent me an email that said: “I have to reschedule”, “How is Tuesday afternoon?”

September 5, 2014 I replied to you by email to “confirm reschedule” for Sept 9 as requested. The email also said: “If you cannot make it please call me”, and “I waited 2 1/2 hours and left 2 phone messages without a courtesy call from you” because you did not show up for our last meeting.

September 9, 2014 I sent you an email: “Please confirm your on-site appointment for 1pm today.”

September 9, 2014 you responded and confirmed the appointment.

September 9, 2014 you had a brief on site meeting with us at our home.

The following are some of the issues that were discussed with you:

1-The main issue is the culvert under Mud St Regional Rd 73 – “needs to be bigger”.

2- The VanBuuren Drain Extension “A” “landfill was used by the township to block” the VanBuuren Drain - “remove the fill that the Township put in”.

3- “Re-open the roadside ditch” at the corner of our street and redirect the water back to it.

4- “Maintain the VanBuuren Drain.”

5- Our neighbour “filling in our ditch with debris”.

Ministry of the environment xxx was contacted. He visited the area and has instructed our neighbour to remove the debris by October 26, 2014.

6- The problems with the VanBuuren Drain “culvert alongside the airport”. Sources of late say - “there are two culverts put together to make one for the farmer”. “The middle has collapsed”.

The above meeting was cut short because as you know we had a previous engagement, and you were 20 minutes late. We would still like to finish our conversation with you now that you have seen the area when it's dry, and know what the issues are; it would be beneficial for you to view it when it’s flooded. We will be in contact to reconvene with you during the next flood.

September 24, 2014 I sent you an email: “Looking forward to hearing from you in regards to your on site visit to our home.” and I asked “Have you have taken any action to resolve the flooding issues?”

September 24, 2014 you responded back in an email: “I apologized for not getting back to you sooner.”, “I spoke to xxx from Grimsby and he said they are cleaning the culvert out this year and a full clean out next year.”

September 29, 2014 you sent me an email: “You may have noticed that Grimsby Public Works has cleaned culvert by the Airport; we will be looking to do a full clean out of the VanBuuren Drain in 2015 (West Lincoln and Grimsby).”

We have not as been able to confirm that anything has been “cleaned” out in the “culvert by the airport”. For us to “have noticed” we would need to trespass on private property.

Your recent emails are good news and we thank you for them, but could you be more specific?

What is a “clean out”, what is “full clean out” and what is “looking to do a full clean out”?

Will you be addressing all the issues that were discussed, including the main issue of the undersized culverts?

When engineers design new Development they must account for the added water that flows to a Municipal Drain (VanBuuren drain). We are currently investigating the recent Michael St. Development holding pond. How much water is being added to the new VanBuuren Drain Extension “A” from this Development?

This is an urgent matter that needs to be resolved soon. I have been instructed that their maybe legal issues with our ditch that the West Lincoln Township has hooked up a Municipal Drain into, and backs up into yards and buildings. Though helpful unfortunately “looking to do a full clean out” next year could be too little, too late.

To be clear, this letter serves to instruct you that the legal issues are now with you - as you have been informed of the flooding issues that you are responsible for.

Dear Mr. xxxx:

Thank you for responding to my email of August 31, 2014 regarding the repair and maintenance you are responsible for. As I mentioned in my email Municipalities that fail to carry out drain repairs can be held liable. I appreciate you cooperation, however the tone that you have set in your response is quite offensive.

According to your comments you still don’t understand “what the issue is” and everything is “fabricated from speculation” Nothing is fabricated. What do you not understand, the flooding pictures, the flooding videos? Do you not understand the urgency and severity of this situation?

Are you claiming that you do have a report that was sent to you by xxxx xxxx 905-xxx-xxx Ext: xxx the Manager of Road Operations Water & Wastewater at West Lincoln Months ago?

I will be happy to share Mr. xxxx voice message that he left on our answering machine states:

“We know there’s a problem with the VanBuuren Drain” ,and he has “fired off the report to the drainage superintendent to review”.

Why isn’t something being done about the flooding if you already know?

As you know we have been trying for some time now without success to resolve the flooding caused by the Regional Road 73 (Mud St.) culvert obstructing the VanBuuren Municipal Drain.

The constantly flooding of many acres of land in our area has been caused in part by the new VanBuuren Municipal Drain “A” extension that becomes overwhelmed by water regularly.

Our little community of flooded yards, basements, buildings, driveways every year is damaging our relationships with our neighbours. The floods here have everyone wondering were the water should go and why it didn't just go down the roadside ditches rather than threw our yards.

Why is this township putting all this water in our yards and denying there is a serious flooding problem? The township could have simply opened the road side ditches that the former owner of the land filled in -at the corner of South Grimsby Rd 12, and some of this water would have gone down alongside the road -like the rest of the province of Ontario’s water does. Rather than threw our land causing destruction, chaos and a community at odds. We enquire as to why there is a water path allowed to be illegally blocked as a water course alongside South Grimsby Rd 12 that diverts the water to our ditch. How is it that the previous owner of the land was allowed to fill in the roadside ditch?

The flooding of our lands has caused legal issues. The Township is using our land, our ditch, our pond, as an over flow for the waterways.

Because our neighbour did not agree to have hundreds of feet of cement culverts run threw the middle of their yard the township had the police stay out here for a week to have the VanBuuren Municipal Drain “A” extension put threw. Everyone one effected by this extension agrees this water should have gone down the roadside ditch rather than threw yards.

The new VanBuuren Municipal Drain “A” extension empty s into our ditch (that was dug by a farmer back in the day). Why would you hook up a municipal drain to our ditch without maintenance, our permission, or consultation? As you know Ditches go into a municipal drain, not the other way around.

So far in this flooding conflict buildings were burned, threats were made. This water war that was purposely created in part by xxxx xxxx former Drainage Superintendent still rages on today.

In turn neighbours continue to bring in hundreds and hundreds of loads of fill that continue to arrive, diverting water here and there upon their neighbours land. This process has gone on for 14 years that we know of, and has melted down to whoever has the lowest land gets flooded.

The township continues to allow new development in this area, building large country homes on lots that disperse many acres of water. These new developments have then brought in hundreds and hundreds of loads of unsupervised landfill, again increasing the disbursement of water going into our unmentioned, unmaintained, inadequate, natural waterway and backing up into our ditch that is joined to the VanBuuren Municipal Drain.

The township has land filled the downstream property with the excavation fill from the VanBuuren Drain Extension ‘A”. This was a very shady act committed against the adjacent land owners.

I feel it may have been done for some payback to the above mentioned land owner. Now when the water backs up -because the Mud St. Culvert is too small, the river of water goes around the landfill that the township has put there and comes our way at an alarming rate. Simply put - the township has caused our lands to flood, they need to come back and fix the problem either by taking the fill back out that they put in, or making sure the waterways are working.

As you can clearly see in the videos and pictures there are many flooded acres of land. It maybe hard to understand just how bad the flooding gets until you come and see the land when it’s not flooded. On the Grimsby Floods West Lincoln site below you will also find pictures of the culverts banks of the Mud St. road that have been caved in and the road is splitting where the VanBuuren Drain crosses.

xxxx xxxx Public Works Supervisor Road Operations says that he is responsible for the culvert at Regional Road 73 (Mud St.). He said in an email referring to the culvert in question: “I replaced it last fall”. As you can clearly see in the pictures posted on the site below there are no signs of repair or replacement at the location. He now has not responded to anymore emails since I called him on his deception. There are videos of the culvert running at max flow rate that were sent to xxxx xxxx Drainage Superintendent years ago. We require you to respond to this facsimile and let us know what is going to happen when we maintain and widen our ditch that the township has joined a municipal drain up to without our permission?

Neighbours that have been taking the brunt of the flooding (basement with more that 4 feet of water) are quite concerned that the municipal drain extension will actually bring the VanBuuren Drain to them threw our ditch, and even over Regional Road 73. They have been filling in the ditch with what ever debris they have, and he says that he is going to bring in 300 loads of fill. This will undoubtedly bring the water out onto South Grimsby Rd xx again, and effect more properties on both side of the road, again, proving again, just how bad an idea it was to put a municipal drain into an unmaintained ditch in a field rather than go down the road side like everywhere else.

We have been slow to react to this fiasco and have allowed our pond to be used as a runoff, backing up into our buildings, killing wildlife, destroying, and flooding out most of our land regularly. I’m sure you would get pissed off if it was your property that was underwater.

Until the township can resolve the flooding I kindly request the township help relieve some of the flooding by diverting the new VanBuuren Municiple Drain Extention “A” water back to the roadside ditches and out of our lands, buildings, driveways, and homes.

I kindly ask that you take this enquiry seriously and give it the attention it deserves. No-one is trying to “fabricate” anything. We just want the flooding to stop. The flooding can be resolved with simple maintenance and a bigger culvert. We welcome your help in resolving this issue as soon as possible.

Flooding continues as road culvert backs up VanBuuren Drain

There is a overwhelming amount of water that forms into lakes and makes its way to the culvert located under regional road 73 (Mud St.).

These lakes can't get threw the undersize culvert quick enough and backs up into our yards.

The Supervisor of Road Operations, admits that he is responsible for the culvert, but fails to acknowledge that there is any problem. He says "I replaced it last fall", referring to the culvert.

The following pictures were taken of the road on top of the culvert March 15, 2014, and again on May 13, 2014. There is no evidence that the road was dug up to replace the culvert.

 

Grimsby and West Lincoln officials have been contacted on many occasions regarding the flooding.

On May 13, 2014 a report was made to West Lincoln Public Works and the link to this blog was given to them regarding the flooding. I was transferred to the Drainage Superintendent. He said that he will send someone out.

An official did call from West Lincoln and left a message saying 

“We know there’s a problem with the VanBuuren Drain” ,and he has “fired off the report to the drainage superintendent to review”.

Niagara Region's Road Operations Manager was also contacted on July 7, 2014 about the flooding. 

He has not responded to date.

It’s a long road trying to get officials from 2 municipalities to clear debris from the VanBuuren municipal drain.

One part of the drain is located downstream in Grimsby. The other is upstream in west Lincoln with an undersized culvert in the middle backing up the water.

Many emails have been sent and received. Some have been answered, some not.

On July 16, 2013 we finally had some evidence that West Lincoln does maintenance. They showed up in my neighbour’s yard with machinery. They cut the grass.The Dump truck delivered some pond rock that was put into 3 piles in their yard.Then the Backhoe was parked over night in their yard.

I sure hope that it wasn’t leaking any diesel fuel this time.

 

On the second day the crew repaired the side of the bank that was caved in. They dug out the cave in and installed pond rock.

I guess they would only install the rock after the cave in happened and all our yards flooded. Ha, ha, who could have known this would happen, nudge, nudge, wink, wink?

Obviously the new VanBuuren drain extension was not properly configured and without the drain lined with rock and a program of maintenance there will continue to be flooding.

Officials should know this right, especially since they have seen the flooding pictures on this site.

Maybe that’s the idea. They must come back to do maintenance on this creation of theirs. As you can see they cut a lot of grass. Why did they not cut it in the ditch!

How much did it cost for the excavation of our neighbours properties and install culverts 500 foot long linked together. And then come back later to install a metal culvert over top of the undersized cement one. Hiding the real size.

How much did it cost to dig up the road and install 2 catch basins on each side of the road?

How much did it cost to have police on hand for the two weeks it took to enforce the ludicrousness of the wishes of the Township of West Lincoln to put the water from road side ditches threw yards, instead of where it should go, down the roadside? 

How much did it cost to battle our neighbor in court?

How much did it cost to plan all this that we the residences did not want?

And now how much will it cost to maintain.

One resident says a culvert is to blame.

xxxxx Drainage Superintendent of West Lincoln says the flooding is normal.

xxxx at the Niagara Conservation Authority says there was no risk of major floods after January thaw. He is scheduled to visit the area.

xxxx Drainage Superintendant of Grimsby says he inspected the culvert and debris had started to buildup at the end of the culvert.

Staff has been scheduled to remove the debris.

Issues Should the design of the drain be altered in configuration or location? Should the assessments be adjusted? Evidence Appellant: Mr. Orgar Mr. Orgar testified that he and his wife purchased their property in 2007. He produced a number of photographs illustrating the drainage problems along South Grimsby Road 12 and also on his property. The photographs depicted several pipe culverts almost totally filled with sediment. Mr. Orgar objected to the proposed drain being located on his property. He proposed that the water from the road pipe culvert in front of his property should be rerouted northward along the east road ditch of South Grimsby Road 12 to Mud Street (Regional Road No. 73) then eastward along Mud Street to the VanBuuren Drain. The photographs also indicated that there were drainage problems at the rear of Mr. Orgar's property. With respect to the alignment of the open portion of the drain as proposed in the Engineer's report, Mr. Orgar suggested that the channel should be rerouted onto the neighbouring Culette property to continue with the alignment of the tile portion of the drain. In response to questions by the Tribunal, Mr. Orgar confirmed that one of the photographs indicated that the water from the road pipe culvert in front of his property was flowing east along the north edge of his property in the location of the drain proposed in the Engineer's report. Appellant: Ms. Clemencio The Clemencio's purchased their property in 2007. Ms. Clemencio argued that the drainage issues being addressed in the Engineer's report were largely caused by the Municipality's inaction in dealing with drainage when they approved the severances of lots along South Grimsby Road 12. She stated that the Municipality should be held accountable for this inaction and therefore should pay a larger portion of the drainage costs. Appellant: Mr. Petropoulos Mr. Petropoulos did not attend the hearing. However, he provided a written submission indicating the same concerns as Ms. Clemencio. The Engineer who prepared the report: John Spriet Mr. Spriet provided an overview of his report. He testified that he did not agree with the alternative design route as proposed by Mr. Orgar. He presented engineering elevation measurements which indicated that it was not feasible to route the water northward along the east road ditch of South Grimsby Road 12 to Mud Street (Regional Road No. 73) then eastward along Mud Street to the VanBuuren Drain. The Engineer presented a series of photographs taken in 2004 depicting the drainage problems along the proposed drain. The Engineer testified that the drain has been designed for a 38 mm (1.5") drainage co-efficient which is an acceptable design for a rural drainage project. He indicated that the 400 mm (16") tile drain will carry the drainage water adequately with the exception of overflow during extreme storm events. He stated that the open channel design at the outlet of the drain was more than adequate to carry the design flow. In response to Mr. Orgar's suggestion that the downstream portion of the open channel should be rerouted off his property and onto the neighbouring Culette property, Mr. Spriet stated that the proposed alignment of the channel closely follows the existing overland drainage flow route. In response to the arguments raised by Ms. Clemencio and Mr. Petropoulos, Mr. Spriet stated that he was aware of the severances of lots that were granted by the Municipality since the time of his appointment in 2003, and that he had considered this in determining the assessment to the Municipality (South Grimsby Road 12). He provided several worksheets to support his assessment calculations. Analysis and Findings The Tribunal accepts the elevation evidence provided by the Engineer illustrating that it is not feasible to divert the flow of water from the existing road culvert on the Orgar property line northward along the east road ditch of South Grimsby Road 12 to Mud Street (Regional Road No. 73) and then easterly to the VanBuuren Drain. The Tribunal also accepts the Engineer's justification for the proposed alignment of the downstream open portion of the drain. Mr. Orgar did not present any substantive evidence to refute the professional evidence of the Engineer. He also did not provide any substantive evidence to suggest any feasible alternative designs to contradict those proposed by the Engineer. The Tribunal has reviewed the assessments in the report, supported by the Engineer's assessment worksheets, and finds the methodology to be in general compliance with the Drainage Act and in keeping with accepted engineering practices. The Tribunal accepts Ms. Clemencio's evidence that the Municipality failed to adequately address drainage issues as part of the severance of lots. However, the Tribunal is satisfied that the Engineer adequately considered this in setting the assessment to the Municipality (South Grimsby Road 12). Accordingly, the Tribunal accepts the Engineer's assessments against the Municipality to be reasonable in the circumstances. Order of the Tribunal The Tribunal Orders that: The appeals by Dave and Jackie Orgar under sections 48(1) and 54(1) of the Drainage Act; and the appeals by Andrea and Jorge Clemencio, and John Petropoulos under section 54(1) of the Drainage Act are denied. The non-administrative costs of the Municipality in respect to this appeal shall form part of the cost of the drainage works, and it is ordered that there be no other order as to costs and all parties are responsible for their own costs. Grimsby Floods West Lincoln

West Lincoln official says the flooding is normal.

 On January 18, 2013 the Niagara Peninsula Conservation Authority says the recent snow melting and rainfall is not posing a major flood risk.

The NPCA said watercourse conditions will not reach critical flood levels in the region.
